TERMS AND CONDITIONS OF THE ONLINE STORE

These Terms and Conditions define the general terms, rules, and manner of sale conducted by Barbara Wyroślak, operating a business under the name “Quill & Fly” Barbara Wyroślak, with its registered office in Jastrzębie-Zdrój, via the online store available at www.quillandfly.com (hereinafter referred to as the “Online Store”), and set out the rules and conditions for the provision of free electronic services by Barbara Wyroślak, operating under the name “Quill & Fly” Barbara Wyroślak, with its registered office in Jastrzębie-Zdrój, ul. Majowa 15.


§1 Definitions

  1. Business Days – weekdays from Monday to Friday, excluding public holidays.

  2. Delivery – the actual activity of delivering the Goods specified in the order to the Customer by the Seller via a Carrier.

  3. Carrier – an entity cooperating with the Seller in the delivery of Goods:
    a) a courier company;
    b) Poczta Polska S.A. with its registered office in Warsaw.

  4. Password – a string of letters, numbers or other characters chosen by the Customer during Registration, used to secure access to the Customer Account.

  5. Customer – an entity for whom electronic services may be provided or with whom a Sales Agreement may be concluded.

  6. Consumer – a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity.

  7. Customer Account – an individual panel assigned to each Customer, created after Registration and conclusion of an agreement for maintaining the Customer Account.

  8. Entrepreneur – a natural person, legal person or organizational unit conducting business or professional activity in its own name.

  9. Entrepreneur with Consumer Rights – a natural person concluding a Sales Agreement directly related to their business activity, where the agreement does not have a professional character for that person.

  10. Terms and Conditions – these Terms and Conditions.

  11. Registration – an action required to use all functionalities of the Online Store.

  12. Seller – Barbara Wyroślak, operating under the business name “Quill & Fly” Barbara Wyroślak, ul. Majowa 15, 44-337 Jastrzębie-Zdrój, Poland, NIP: 6331198631, REGON: 381682406, EORI: PL633119863100000, entered in the Central Register and Information on Economic Activity, e-mail: quillfly5@gmail.com, owner of the Online Store.

  13. Store Website – websites operated by the Seller under the domain www.quillandfly.com.

  14. Goods – products presented by the Seller that may be the subject of a Sales Agreement.

  15. Durability – the ability of the Goods to retain their functions and properties during normal use.

  16. Durable Medium – a medium enabling storage of information in an unchanged form for future access.

  17. Sales Agreement – a distance sales agreement concluded between the Customer and the Seller.


§2 General Provisions and Use of the Online Store

  1. All rights to the Online Store, including copyrights, intellectual property rights, domain name, website content, templates, forms and logos (excluding third-party product images and logos), belong to the Seller.

  2. The Seller makes every effort to ensure compatibility with commonly used browsers and devices. Minimum requirements include an up-to-date web browser with JavaScript and cookies enabled and an internet connection of at least 256 kbit/s.

  3. The Store uses cookies to ensure proper operation. Cookies do not damage devices or software. Customers may disable cookies, which may limit Store functionality.

  4. An active email account is required to place orders and use electronic services.

  5. It is prohibited to provide unlawful content or use the Store in a manner contrary to law, good morals, or the rights of third parties.

  6. Due to risks associated with internet use, Customers should use appropriate security measures. The Seller never requests Customer passwords.

  7. The Store may not be used for activities harmful to the Seller, including advertising other businesses or publishing misleading content.


§3 Registration

  1. Registration is free of charge and required to place orders.

  2. The Customer completes the registration form and sets an individual Password.

  3. Acceptance of these Terms and Conditions is required during Registration.

  4. Consent to marketing data processing is voluntary and may be withdrawn at any time.

  5. Within 7 days of Registration, the Customer receives confirmation by email, concluding the agreement for maintaining the Customer Account.


§4 Orders

  1. Information on the Store Website does not constitute an offer within the meaning of civil law, but an invitation to submit offers.

  2. Orders may be placed 24 hours a day, 7 days a week.

  3. Goods are added to the cart using the “ADD TO CART” option. Orders are placed using the “ORDER WITH OBLIGATION TO PAY” button.

  4. Placing an order constitutes an offer to conclude a Sales Agreement.

  5. Confirmation of order receipt and acceptance is sent to the Customer by email.

  6. The Sales Agreement is concluded upon acceptance of the order by the Seller.

  7. The terms of the Sales Agreement are provided to the Customer on a Durable Medium.


§5 Payments

  1. Prices shown on the Store Website are gross prices and do not include delivery costs.

  2. Available payment methods include:
    a) bank transfer;
    b) bank transfer with personal pickup;
    c) PayPal;
    d) cash on delivery;
    e) cash on personal pickup.

  3. Payment deadlines are specified during the ordering process.

  4. Failure to make payment within the specified deadline may result in withdrawal from the Sales Agreement by the Seller.


§6 Delivery

    1. Delivery is available within the European Union, the United Kingdom, Asia, Australia, New Zealand, the United States, Canada, Africa and South America.

    2. Goods are delivered via a Carrier to the address provided by the Customer.

    3. The Customer should inspect the parcel upon delivery. Any damage should be reported immediately to the Carrier.

    4. Personal pickup is available by prior arrangement with the Seller.

    5. Receipts or VAT invoices are issued according to the Customer’s declaration.

    6. For deliveries outside the European Union, the Customer may be required to pay customs duties, import taxes, VAT or other charges imposed by local customs or tax authorities in the destination country. These costs are not included in the price of the Goods or delivery costs and shall be borne solely by the Customer. The Seller has no control over these charges and is not able to estimate their amount.

    7. Packages are generally dispatched within up to 5 Business Days after receipt of payment, unless a different dispatch time is indicated on the Store Website.

    8. Shipments are carried out via courier companies specified by the Seller and may include tracking and delivery without a required signature. If the Customer requests delivery with a required signature, additional costs may apply and must be agreed with the Seller prior to shipment.

    9. Regardless of the selected delivery method, the Seller shall provide the Customer with a shipment tracking link, where available.

    10. Shipping fees include handling, packing and postage costs. Handling fees are fixed, while transport fees depend on the total weight of the shipment.

    11. The Seller recommends placing all items in a single order. Orders placed separately cannot be combined into one shipment and are subject to separate shipping charges.

    12. Goods are packed with due care to protect the contents, including fragile items. The risk associated with the Goods passes to the Customer in accordance with applicable law.

§7 Warranty for Entrepreneurs

  1. The Seller is liable for defects in the Goods toward Entrepreneurs under statutory warranty rules applicable to Entrepreneurs.

  2. Complaints should be submitted in writing or electronically to the Seller’s contact details.

  3. The Seller shall respond to complaints within 14 days of receipt.


§8 Guarantee

  1. Goods may be covered by a manufacturer’s or distributor’s warranty.

  2. Detailed warranty conditions, if applicable, are provided on the Store Website or with the Goods.


§9 Non-conformity of Goods with the Contract

(Consumer and Entrepreneur with Consumer Rights)

  1. Goods must comply with the Sales Agreement, in particular with regard to description, quality, quantity and functionality.

  2. The Seller is liable for non-conformity of the Goods with the contract existing at the time of delivery and revealed within the statutory period.

  3. In the event of non-conformity, the Customer may request repair, replacement, price reduction or withdrawal from the Sales Agreement in accordance with applicable law.

  4. Due to the natural origin of certain Goods, in particular fly tying materials such as feathers, quills, dubbings or furs, minor differences in color, shade, texture, length or structure may occur. Such differences are a natural characteristic of these products and do not constitute a defect or non-conformity of the Goods with the contract.


§10 Withdrawal from the Sales Agreement

  1. A Consumer or an Entrepreneur with Consumer Rights has the right to withdraw from the Sales Agreement within 14 days without giving any reason.

  2. A statement of withdrawal may be submitted by post or electronically.

  3. The Seller shall refund all payments received from the Customer within 14 days from receipt of the withdrawal statement, subject to the return of the Goods.

  4. Refunds shall be made using the same payment method used by the Customer, unless the Customer expressly agrees to a different method.

  5. The right of withdrawal does not apply to Goods excluded by applicable law, including sealed Goods that were opened after delivery.


§11 Free Electronic Services

  1. The Seller provides the following free electronic services:
    a) contact form;
    b) newsletter;
    c) Customer Account.

  2. The newsletter service is voluntary and may be cancelled at any time.

  3. The Seller may block access to electronic services in the event of violations of the Terms and Conditions or security risks.


§12 Personal Data Protection

Rules concerning the protection and processing of personal data are set out in the Privacy Policy available on the Store Website.


§13 Termination of Electronic Services Agreement

  1. Either party may terminate the agreement for the provision of electronic services at any time.

  2. Termination may be made via electronic communication.


§14 Final Provisions

  1. The Seller’s liability toward Entrepreneurs is limited to damage caused intentionally, to the extent permitted by law.

  2. Polish law shall apply to all agreements concluded under these Terms and Conditions.

  3. The Seller reserves the right to amend these Terms and Conditions for important reasons, with prior notice provided to Customers.

  4. The Seller shall not be liable for failure or delay in the performance of obligations resulting from events beyond the Seller’s reasonable control, including but not limited to acts of God, natural disasters, strikes, epidemics, customs delays, carrier disruptions, or interruptions in transport or communication systems.

These Terms and Conditions enter into force on 28 December 2025.
